This document aims to establish the Terms and Conditions of Use (hereinafter, TCU) for the mobile applications “upna Academic Mobile” and “upna PAU” (hereinafter, the Application, referring indistinctly to either of them), which are owned by Public University of Navarre (UPNA), with tax ID code no Q3150012G, and contact details as follows:
After installing the Application on a mobile device, its use will at all times require the user's express consent to these TCU and to the Privacy Policy.
The use of the Application confers the status of user (hereinafter, the User) and implies the reading, understanding, and acceptance of the TCU set out in this document, as well as of the Privacy Policy.
The University reserves the right to amend these TCU, and it is the User’s responsibility to review them periodically. Use of the Application, subject to prior express consent, shall be understood to imply acceptance of and agreement with any such modifications.
The most recent version of the current TCU following any modification, as well as the Privacy Policy, will be accessible via the links displayed on the initial screen of the Application (the one requesting User login), next to the switch for granting express consent.
The Application is a work composed of various integrated and inseparable elements, whose intellectual property rights, in accordance with the applicable regulations, belong to UPNA, except for those materials obtained under license, authorization, or consent from third parties.
UPNA shall retain at all times the intellectual and exploitation rights over the Application and its individual components, granting only the right of use.
Any rights not expressly granted shall be deemed reserved in favour of the University.
The User acquires no rights through the use of the Application.
The University is responsible for the selection, structural design, and arrangement of the contents of the Application and, therefore, is entitled to the protection granted by Intellectual Property Law in this regard.
UPNA also holds exclusive ownership of the design and graphic appearance of the Application, and reserves the right to take legal action against any individuals who may imitate or make unfair use of it.
The Application is intended solely for individuals who are enrolled as official students at UPNA.
To use the Application, the User must first verify their student identity through the coordinated credentials system by entering their assigned username and password.
This credential is issued to students at the beginning of their academic journey at UPNA to allow access to the various online services offered.
The User shall be solely responsible for safeguarding this credential for personal use only, agreeing not to share it or allow access by third parties, and accepting responsibility for any damage or harm resulting from its misuse. Any unauthorized access, misuse, abuse by third parties, or theft of credentials must be reported to UPNA.
The User must have a mobile device with Android or iOS operating system and secure, reliable internet access.
UPNA shall not be held responsible for the security of the devices used by the User to access the Application, nor for service availability on those devices it is installed in.
It is the User's responsibility to ensure the availability of appropriate tools to prevent, detect, and remove malicious software or any other harmful digital elements. UPNA shall not be held liable for any damage to the User’s mobile devices resulting from the use of the Application.
Nor shall UPNA be liable for damages to the User resulting from failures or disconnections in telecommunications networks that interrupt the service.
UPNA may, without prior notice, provide new versions that include technological or functional improvements and bug fixes, to enhance the services offered to the User. This may include changes to, removal of, or addition of content and services, as well as modifications to their presentation or placement.
UPNA will endeavour, as far as possible, to keep the Application updated and free of errors. In any case, access to and use of the Application is the sole responsibility of the User.
The Application may receive communications from UPNA through push notification technology on the devices where it is installed.
These notifications are purely informational and will not affect the User’s legal rights and obligations as a student.
The User agrees to use the services and content offered by the Application in accordance with the principles of good faith and commonly accepted practices.
Any use for unlawful purposes or contrary to these TCU that may harm the interests or rights of third parties is strictly prohibited.
UPNA accepts no liability for any actions performed by the User resulting from misuse of the Application.
It is strictly prohibited to register the Application on behalf of another person without UPNA’s authorization.
The User agrees to use the Application and its contents appropriately and in compliance with the law, these TCU, generally accepted moral standards, and public order.
The following actions, by way of example but not limitation, are expressly prohibited:
UPNA shall not be liable for any damage or loss the User may suffer while using the Application due to viruses or other similar elements. It shall also not be responsible in any case for service disruptions caused by failures in the data network of the telecommunications provider.
Legal Action
In the event of a breach of these TCU by the User, the University is entitled to take any legal action it deems appropriate under current legislation.
UPNA will pursue any unauthorized or inappropriate use of the Application or its contents, as well as any infringement of its rights, particularly those related to intellectual and industrial property.
